What is the procedure to follow to transmit this type of service?

A television service can be transmitted by:

  • broadcasting frequencies
  • cable networks
  • satellite, or by
  • any other electronic communications network (e.g., the internet).

Any provider intending to offer a television service must have previously obtained a permission or a concession from the Department of Media, Connectivity and Digital Policy.

In particular, with regard to television services transmitted by any other electronic communications network (e.g., the internet), obtaining a permission or a concession is not necessary for its transmission. The provider of such service nevertheless must, at the latest 20 days before the launch of said service, notify its intention to the Minister in charge of the media.

What is the role of ALIA in terms of supervision?

Audiovisual media service providers falling within the competence of the Grand Duchy of Luxembourg are subject to the ALIA’s supervision.

As part of its supervisory mission, the Authority ensures in particular that the programmes broadcast by the audiovisual media services falling within its competence:

  • respect human dignity
  • do not contain any incitement to violence or hatred
  • do not contain any public provocation to commit a terrorist offense
  • comply with the provisions relating to the protection of minors
  • comply with all obligations regarding commercial communications

It should be noted that providers with a concession or permission may be required to comply with additional provisions arising from the requirement specifications of such concessions and permissions.
