The European directive on audiovisual media services (“AVMS Directive”) provides that television and video-on-demand (VOD) services must broadcast a minimum quota of European works.
The Authority’s mission is to encourage audiovisual media service providers who fall within its competence to ensure that the services they offer promote, when feasible and by appropriate means, the production of European works as well as the access to such works.
At least 50% of the programmes broadcast on television services must be of European origin.
At least 10% of the programmes broadcast by television services must come from independent European producers.
The time of news programmes, sports events, games, advertising, teletext services and teleshopping is not considered in the calculation.
Each television service provider within the competence of Luxembourg provides ALIA with a report on the fulfilment of the required quotas.
The quotas do not apply to local television services, nor to television services exclusively used for teleshopping or self-promotion.
Audiovisual media services on demand, better known as video on demand (VOD) services under the jurisdiction of Luxembourg must offer at least 30% of productions of European origin in their catalogues.
Video on demand (VOD) service providers send a report every 4 years on the implementation of the 30% minimum threshold to ALIA.
The obligations do not apply to VOD services with a low turnover or a small audience, or for which it is impossible to comply with the obligations due to the nature or topic of the services offered.
